DIANOVA INTERNATIONAL ORGANISATION welcomes you and invites you to read carefully the General Conditions of Use of this Website, which describe the terms and conditions that shall be applicable to navigation within the site, in compliance with the relevant Spanish legal norms. As DIANOVA INTERNATIONAL ORGANISATION could in future modify  these Conditions of Use, we recommend that you consult them periodically in order to be informed of any changes made.

1. Aim

DIANOVA INTERNATIONAL ORGANISATION provides the content and services that are available on the Website, subject to the current General Conditions of Use as well as to current policy on the treatment of personal data (henceforth “Policy on Data Protection”). Access to this Website or its use in any form assigns the status of User and implies the acceptance without reservation of all and every one of the current Conditions of Use, reserving to DIANOVA INTERNATIONAL ORGANISATION the right to modify them at any time. Consequently, it shall be the responsibility of every User to read carefully the General Conditions of Use in effect at the time of every visit to the Website, because if the use is not in accordance with the conditions set out therein, the User should abstain from using the Website.

Similarly, the User is advised that from time to time particular conditions may be established for the use of contents and/or services of the Website, and that the use of the content or services shall imply the acceptance of the particular conditions specified therein.

2. Privacy and Treatment of Data

When it is necessary to provide personal data in order to access certain content or services, the User shall guarantee the data’s veracity, accuracy, authenticity and validity. DIANOVA INTERNATIONAL ORGANISATION shall subject these data to the automated data processing that corresponds to their nature and purpose, according to the terms indicated in the Section entitled Policy of Data Protection.

3. Industrial and Intellectual Property

The User recognises and accepts that all content shown on the Website and, in particular, designs, texts, images, logos, icons, buttons, software, trade names, brands or any other signs capable of being used industrially and/or commercially are subject to intellectual property rights, and that all brands, trade names or distinctive designs, all intellectual and industrial property rights over the content and/or other elements inserted in webpage are the exclusive property of DIANOVA INTERNATIONAL ORGANISATION and/or of third parties, who have the excusive right to use them in the course of trade. Any other use or exploitation of any of the rights conferred herein will  be subject to the prior and express authorisation granted specifically for such use by the DIANOVA INTERNATIONAL ORGANISATION or by the third-party owner of the rights affected.

The content, texts, photographs, designs, logotypes, images, computer programs, source codes and, in general, any intellectual creation extant on the site, as well as the site itself in its entirety as an artistic multimedia work, are protected as copyright by intellectual property legislation. DIANOVA INTERNATIONAL ORGANISATION holds the title to the elements that comprise the graphic design of the Website, menus, navigation buttons, the HTML code, texts, images, virtual textures, graphics and other content of the Website, or in any case has the relevant authorisation to use those elements.

The User of this Website undertakes to respect the rights set out herein and to avoid any action that may prejudice them. DIANOVA INTERNATIONAL ORGANISATION reserves the right to take any corresponding measure or legal action in defence of its legitimate intellectual and industrial property rights.

4. Duties and Liabilities of the Website User

The user undertakes to:

a) to make appropriate and legitimate use of the Website, its content and services, in accordance with:

(I) current applicable legislation;

(II) the General Conditions of Use of the Website;

(III) generally accepted standards of morality and decency;

(IV) public order.

b) The User undertakes to use all media and technical requirements that may be necessary to access the Website;

c) To provide accurate information when filling in personal data on the Website’s forms and to keep the data updated to reflect the User’s current circumstances. The User shall be the only party liable for any false or inaccurate statements that he or she provides and for any damage that these may cause to DIANOVA INTERNATIONAL ORGANISATION or to third parties

(VII) DIANOVA INTERNATIONAL ORGANISATION and third parties are protected by industrial and intellectual property legislation against such unauthorised use as the User intends to carry out:

(VIII) whether such use is contrary to honour, personal and family privacy or to one’s self-image;

(IX) whether it constitutes any kind of advertising;

(X) whether it includes any kind of virus or program that obstructs the normal operation of the Website.

If the User is provided with a password with which to access some of the services or content of the Website, he or she is obliged to use it in a diligent manner, keeping it safe at all times. 5. Liabilities

DIANOVA INTERNATIONAL ORGANISATION does not guarantee continuous access, nor correct display, download or use of the elements contained within the pages, which may be hindered, corrupted or interrupted by factors or circumstances beyond our control.

DIANOVA INTERNATIONAL ORGANISATION is not responsible for decisions that may be adopted as a consequence of access to the content or information offered.
DIANOVA INTERNATIONAL ORGANISATION reserves the right to interrupt the service or terminate with immediate effect the relation with the User if it detects a use of its Website or of any of the services offered therein that is contrary to the current General Conditions of Use.

DIANOVA INTERNATIONAL ORGANISATION is not liable for damages, losses, claims or expenses incurred in the use of the Website. It will be liable solely for the removal, as quickly as possible, of content that may generate such losses, provided adequate notice is given. In particular, it will not be liable for losses that may arise as a result of among other things:

DIANOVA INTERNATIONAL ORGANISATION shall subject such data to automated processing in compliance with Law 15/1999 of 13 December on Personal Data Protection and with the implementing regulation Royal Decree 1720/2007. DIANOVA INTERNATIONAL ORGANISATION shall not be responsible in any way in the event it is unable to offer services, where this inability is due to prolonged interruptions of the electricity supply or telecommunication lines, social conflict, strikes, rebellions, explosions, floods, acts and omissions by the Government, and in general in all cases of Force Majeure or unforeseeable circumstances.

12. Dispute Resolution. Applicable Law and Jurisdiction

The current General Conditions, as well as the use of the Website, shall be governed by Spanish legislation.

In the event that a provision of the current General Conditions becomes unenforceable or void owing to applicable legislation or as a result of a judicial or administrate decision, such unenforceability or nullity will not affect the enforceability or validity of the General Conditions as a whole. In such cases, DIANOVA INTERNATIONAL ORGANISATION will modify or substitute the affected provision for another that is valid and enforceable and that achieves the same objective, as far as is possible, as the original provision.
